Police Retirement Lawsuit

How a Bill Becomes an Act
FOP Legislation

There are many things which have contributed to the FOP's successful legislative efforts over the years. The fact that the Fraternal Order of Police speaks for law enforcement is important. The active involvement and hard work of thousands of FOP members building relationships with their representatives in Columbia and Washington opens doors and convinces legislators to do the right thing when it comes to protecting society's protectors. And certainly having an experienced, well-positioned lobbyist who's known as an advocate for law enforcement is a key part of FOP's success.

The South Carolina Fraternal Order of Police retains a full-time lobbyist to make your voice heard in the South Carolina Legislature. Our lobbyist monitors and consults with other interest groups involved in law enforcement policy, advocacy and political activities on behalf of South Carolina's FOP membership.

Retirement Payback
STATUS: As of a couple of years ago, South Carolina law enforcement retirees must pay back into the Police Officers Retirement System. We consider that decision by the General Assembly unconstitutional and there is a pending law suit about it. SCFOP President, Jerry Wright, submitted a plan he thought may work. We submitted that plan to Senator Larry Grooms (R-Berkeley) who made the request to the Director of the Retirement System, Peggy Boykin. The plan is being reviewed and studied by actuaries hired by the State. The latest information from Ms. Boykin on July 10 stating a “rough estimate” determines if working retirees do not contribute to the System, then active employees OR their employers (agencies) will be required to contribute ˝ %. This also applies if the State loses the pending law suit. There is a court hearing scheduled on this issue for August 20 to determine if class action is feasible.
